Introduction

This Privacy Policy describes how Shaw Industries, Inc., and its affiliates (“Shaw Industries,” “us,” “our,” or “we”) collect, use, and disclose personal information (defined below) through your interactions with our website (“Site”) and use of our product and service offerings (“Services”).  It also describes the cookies we may use and send to your computer or mobile device.

If you are a current or former employee or worker of Shaw Industries, the information about how we handle your personal information as an employee is located on the Shaw Industries intranet or  you can request a copy of the information from your HR representative.

For the purposes of this Privacy Policy, Shaw Industries is a controller (i.e., responsible party) of your personal information when we administer the Services directly on our own behalf. In certain situations, we also administer the Services on behalf of customers or other third parties.  In those instances, Shaw Industries may act as a processor or service provider to such organizations, and you should review the privacy policy of such third parties with whom you are dealing with directly, as they will be responsible for the handling of your personal information.

Types Of Personal Information We Collect.

The types of personal information we collect about you depends on how you interact with us.  “Personal information,” used interchangeably with “personal data,” means information that identifies, relates to, describes, or can be associated with you.  Depending on the Services you use, the table below sets out the categories and specific types of personal information that we may collect, or have collected, from you in the preceding twelve (12) months and how we collect it.

We collect information you submit to us on our Site or through online forms to process your requests, including name, postal address, e-mail address and phone number.

Order Placement (Contact Information/Information Specific to Services/Financial and Payment Information)

We may collect your name, billing address, shipping address, e-mail address, phone number, credit card number and bank details when you place an order.

Web Logs (Internet or Other Network Activity)

We may collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use   the Internet), domain name, click-activity, referring website, and/or a date/time stamp for your visit. Web logs may be used for things like monitoring website usage levels and diagnosing problem.

Device Information (Device Information and Other Unique Identifiers)

We may collect information about the device accessing the website such as MAC address, device type, and device identifiers.

Site Behavior and Cookies (Internet or Other Network Activity)

We may use cookies and clear GIFs. “Cookies” are small pieces of information that a website sends to your device while you are viewing a website. We may use both session cookies (which   expire once you close your web browser) and persistent cookies (which stay on your device until you delete them). Among other things, cookies allow us to provide you with a more   interactive experience and track website usage. Persistent cookies may be removed by following instructions provided by your browser. Where permitted and in accordance with applicable law, of the information collected and listed above, username and password may be considered sensitive personal information.

The provision of the personal information listed above is voluntary. In certain instances, we will not be able to process your request for our Services without the requested personal information. In addition to the specific situations discussed elsewhere in this Privacy Policy, we may disclose the personal information listed above in the following situations set out below. This will only take place in accordance with applicable law.

  • Shaw Industries Affiliates and Acquisitions - We may disclose your personal information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires our company, business, or our assets, we will also disclose your personal information with that company.

  • Other Disclosures with Your Consent - We may ask if you would like us to disclose your information with other unaffiliated third parties who are not described elsewhere in this policy.

  • Other Disclosures without Your Consent - We may disclose personal information in response to subpoenas, warrants, or court orders, in connection with any legal or regulatory process, or to comply with relevant laws. Your Rights and Choices.

You may have certain rights and choices regarding your personal information. Your rights and choices will vary depending on where you are located. Specifically, you may have the following rights and choices:

  • Changes to Your Personal Information. You have the right to request correction of inaccurate personal information we have about you. Depending on the purposes of the processing, you may have the right to have incomplete personal information completed, including by means of providing a supplementary statement. As noted above, you may also be able to correct your information in your account or profile. .

  • Deletion of Your Personal Information. You have the right to request that we delete your personal information. If required by law, we will grant your request to delete information. However, when we delete personal information it will be removed from our active database, but it may remain in archives where it is not practical or possible to delete it. In addition, we may keep your personal information as needed to comply with our legal obligations, resolve disputes, and/or enforce any of our agreements.

  • Revocation of Consent. If you revoke your consent for the processing of personal information then we may no longer be able to provide you certain services. In some cases we may limit or deny your request to revoke consent if the law permits or requires us to do so, if we are unable to adequately verify your identity, or if our processing is not based on your consent. Revocation of your consent will not affect the lawfulness of processing based on your previous consent.

  • Access to Your Personal information. You have the right to request access to the personal information we hold about you, along with other information such as the purposes of the processing, the recipients or categories of recipients to whom the personal information has been or will be disclosed, the sources of the personal information, retention, and transfers of personal information.

  • Data Portability: Under certain circumstances, you have the right to receive the personal information about you that you have provided to us, in a structured, commonly used, and machine-readable format.

  • Object to Processing. You may, as permitted by law, request that we stop processing your personal information.

  • Non-Discrimination. We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy, nor do we retaliate against individuals who exercise these rights.

  • Opt-Out of the “Sale” and “Sharing” of Personal Information. Subject to certain exceptions, California residents have the right to opt-out of the "sale"/”sharing” of their personal information. Making personal information (such as online/device identifiers, browsing activity, or geolocation) available to social media platforms and ad networks to deliver interest-based ads to you may be a “sharing” under California law (in this context “sharing” means cross contextual behavioral advertising). Processes for Exercising Your Rights

Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on the circumstances of the request.  If you choose to assert any of these rights under applicable law, we will respond within the time period prescribed by such law.  In some cases, we may limit or deny your requests to access or delete your information. This may occur because the law permits or requires us to do so, or if we are unable to adequately verify your identity.

If you are located in the State of California in the United States, a person authorized to act on your behalf may make a verifiable request related to your personal information. If you designate an authorized person to submit requests to exercise certain privacy rights on your behalf, we will require verification that you provided the authorized agent permission to make a request on your behalf.

In any circumstances, your request must: (i) provide sufficient information that allows us to reasonably verify that you are the person about whom we collected personal information or an authorized representative of that person; and (ii) describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

How We Protect Personal Information

All our data is stored in written or electronic form on our servers and computers and in various physical locations. We maintain physical, electronic and procedural safeguards to protect your personal information from misuse, unauthorized access or disclosure and loss or corruption by computer viruses and other sources of harm. We restrict access to personal information to those staff members, joint venture partners, subsidiary companies and third parties who need to know that information for the purposes set out in this Privacy Policy.

However, no method of transmission over the Internet, or method of electronic storage, is fully secure. While we use reasonable efforts to protect your personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of your personal information. Our Site permits you to create an account. When you do you will be prompted to create a password. Retention of Personal Information

Your personal information will be retained for as long as it is necessary to carry out the purposes set out in this Privacy Policy (unless longer retention is required by the applicable law). However, we will not retain any of your personal information beyond this period and the retention of your personal information will be subject to periodic review. These cookies enable third-party ad networks to recognize a unique cookie on your computer or mobile device and may be placed by us or our network advertising firm that works with our third-party network advertiser. The information that is collected and shared by cookies may be linked to the device identifier of the device you are using to allow us to keep track of all the sites and mobile applications you have visited that are associated with the ad network. This information may be used for the purpose of targeting advertisements on the Site and Services and third party sites or mobile applications based on those interests.

  • Minors - Our Site and Services are not intended for persons under 18 years of age. Shaw Industries does not knowingly collect or sell personal information from children under the age of 13.

With respect to transfers from the European Economic Area ("EEA") or the United Kingdom (“UK”) to the United States and other non-EEA jurisdictions, we may rely on the European Union (“EU”) Standard Contractual Clauses (“EU SCCs”), and the United Kingdom (“UK”) Addendum to the EU SCCs.   • Third Party Applications and Websites - From time to time, the Site may contain links to other websites not belonging to or under the control of Shaw Industries. We explicitly disclaim responsibility or liability for the privacy practices or the content of websites that do not belong to or are not under our control.

  • Third Party Personal Information - Where you submit information on behalf of another person, you confirm that you have made that person aware of how we may collect, use and disclose their information, the reason you have provided it, how they can contact us, the terms of this Privacy Policy and that they have consented to such collection, use and disclosure.
